Lunar Energy, Inc. and its affiliates (“Lunar,” “we,” “our,” and/or “us”) values the privacy of individuals (“you” or “your”) who use:
(i) our website (https://www.lunarenergy.com (“Website”));
(ii) our customer mobile application (the “Lunar Energy App”), installer application (the “Installer App”), and/or customer support and grid services app (“Gridshare App”) (collectively the “Apps”);
(iii) our home battery system and associated hardware (the “Lunar Home Battery System”);
(iv) our Lunar Home Battery Systems and/or other manufacturer’s distributed energy resources (“Non Lunar DERs”) to participate (or allow a third party owner to participate) in a grid services program, virtual power plant or other energy management program (collectively, “Energy Management Program”), operated by Lunar or other service provider;
(collectively, our “Services”). Lunar Home Battery Systems together with Non Lunar DERs, are collectively referred to as “Devices” in this Privacy Policy.
This Privacy Policy explains how we collect, use, and share personal information from or about you. By using our Services, or allowing third parties to use our Services on a Device, you agree to the collection, use, and disclosure of your personal information as described in this Privacy Policy. Beyond the Privacy Policy, your use of our Website is also subject to our Terms of Service.

If you reside in California, please also review our “CALIFORNIA RESIDENT PRIVACY NOTICE” for more information about the types of personal information we collect and disclose, as well as how to exercise your rights under California law.

We may process some of your information as a processor or service provider on behalf of our customers (for example, on behalf of your Energy Management Program owner) to provide our Services to them. In that context, our processing of your personal information is subject to our agreements with our customers, and therefore our use and disclosure of this data may be subject to additional restrictions.
INFORMATION WE COLLECT
We may collect a variety of personal information from or about you and the Devices you use (or have allowed third parties to use) to access the Services from various sources, as described below.
A. Information You Provide Directly to Us
Account and Profile Information. When you sign up for an account, or register to use the Lunar Energy App, we ask you for your name, email address, postal address, and tariff details. After you create an account, or so register, you may also be asked to update your profile, and provide us with your address and information related to your utility provider, such as the name of your utility provider, and other relevant information about your energy usage. If you agree to participate in an Energy Management Program (or you agree for a third party owner of the Device in your home to participate in an Energy Management Program), we may ask for additional information which is required by regulatory authorities or utilities, or other entities involved in the administration of the Energy Management Program.
Communications. If you contact us directly, we may receive personal information about you. For example, if you contact us through a form on our Website, we will receive any information you provide on the form such as your name, email address, country, zip code, solar array size and/or monthly electricity bill, and the contents of your message. If you contact us for customer support for your Lunar Home Battery System or complete a questionnaire or survey, we may ask for personal information you have provided to us before, or new categories of personal information, and we will collect any feedback you provide. If we provide direct customer support regarding a Lunar Home Battery System, we may receive and/or collect emails, chat transcripts, phone call recordings, support ticket conversations, remote diagnostic session logs, and service visit records. When you communicate with us online, third party vendors may receive and store these communications on our behalf. When we send you emails, we may use embedded pixels or other technologies to track information about your receipt and interaction with our emails, such as whether and when you open them, whether you access any links included in our emails, how long you read our emails, whether you forward our emails and to whom, your Location Information (described below), and your Device Information (described below), to learn how to deliver a better customer experience and improve our product offerings.
Energy Management Programs Data. If your Device is participating in an Energy Management Program, we may ask you for information such as your name, email address, postal address, phone number, your electricity provider or utility, any Non Lunar DER manufacturer, your service agreement ID, utility account number, your permission to operate date, your Device’s installed location, and Device identifiers and installation details.
Partner Personal Information. We also collect personal information of corporate visitors to our Website, employees of our installers, channel partners, Energy Management Program providers, utilities, integration providers, third party owners of Devices, and any Non Lunar DER manufacturer, such as name, phone number, work email address.
B. Information We Collect When You Use Our Website, a Lunar Home Battery System, the Lunar Energy App, or your Device is participating in an Energy Management Program
Location Information. When you use our Website, Apps or a Device, we may infer your general location information (for example, your internet protocol (IP) address may indicate your general geographic region). For a Device participating in an Energy Management Program, we may infer your Device’s general location from information we receive regarding its connection to your local power grid.
Website Browser and Personal Electrical Equipment Information. We receive information about the web browsers and personal electrical equipment (e.g. phones and laptops) you use to access our Website and Apps, including Internet protocol (IP) address; domain names; web browser type; device and application identifiers (including device ID, installation ID, user ID and other unique identifiers); device manufacturer, model and hardware characteristics (including screen dimensions, processor, memory, storage, battery and charging status); operating system name, version and build; App version, build number and update/release identifiers; mobile network information (including carrier, radio/network type and Wi‑Fi connection status, including Wifi service set identifier); push notification tokens; language and locale settings; approximate location derived from IP address or network data (country, region and city); access times, session duration and in‑App activity and interaction data; and diagnostic, crash and error data (including personal electrical equipment state at the time of an error).
Website and App Usage Information. To help us understand how you use our Website or our Apps and to help us improve our Website our Apps and Services, we automatically receive information about your interactions with our Website or Apps, like how you use our Website or Apps, and how often, the pages or other content you view, the searches you conduct, and the dates and times of your visits. We may also collect information such as preferences about our marketing or other activities, and your preferences with respect to such activities.
Information Automatically Collected from Your Lunar Home Battery System. If you have a Lunar Home Battery System, we automatically receive information related to your household energy consumption and solar energy generation, state of charge, thermal monitoring (such as unexpected changes in the temperature), usage, error codes, fault logs, inverter diagnostics, communication logs, and utility grid import and export. Depending on your hardware configuration, we may also receive energy consumption information related to specific circuits or electrical devices in your home.
Information Automatically Collected from your Device for Energy Management Programs. By you or a third party owner participating in an Energy Management Program, you authorize us to automatically receive and store information related to the operation of your Device to facilitate your participation in such an Energy Management Program. This may include information such as your energy usage patterns, your Device’s power rating and energy capacity, Device identifiers, general location, event opt outs, other energy telemetry, and Device configuration information.
Information from Cookies and Other Tracking Technologies. We and third party partners collect information using cookies, pixel tags, SDKs, or other tracking technologies. Our third party partners, such as analytics partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Website. Below is an overview of the types of cookies we and third parties may use to collect personal information.
- Strictly necessary cookies. Some cookies are strictly necessary to make the Website available to you. We cannot provide you with the Website without this type of cookie.
- ●Functional cookies. These are used to recognize you when you return to the Website. This enables us to adapt our content for you, and remember your preferences (for example, your choice of language or region).
- Analytical or Performance cookies. We also use cookies for analytics purposes in order to operate, maintain and improve our Website. We may use our own analytics cookies or use third third party analytics providers such as Google Analytics to collect and process certain analytics data on our behalf.
Where required by applicable law, we obtain your consent to use cookies.
Please review your web browser’s “Help” file to learn the proper way to modify your cookie settings, but note that modifying your cookie settings will not affect other tracking technologies we utilize. Please note that if you delete or choose not to accept cookies from our Website, you may not be able to utilize the features of our Website to its fullest potential.
C. Information We Receive from Third Parties
Installation and Maintenance Partners. If you receive a Lunar Home Battery System from one of our installation or channel partners, or a third party owner that has installed a Lunar Home Battery System in your home, we may receive information about you from our installation, channel partner, or third party owner partner, such as your postal address, signature, email address, phone number, name, the location and photos of the installation, information about your renovations, household specifications, ip address, network identifier, serial number, tariff, interaction with the Lunar Customer App, permission to operate date, your electricity provider or utility, and information about your house related to the installation. We also receive the name of the installation engineer.
Energy Management Program Enrollment and Operational Partners. If (i) you sign up your Device to participate in an Energy Management Program, or (ii) the Device in your home is used by a third party owner to participate in an Energy Management Program, or (iii) your Device is managed by a fleet management system operated by Lunar for your installer or other third party who manages a fleet of Devices, we may also receive information such as your name, email address, postal address, phone number, energy tariff/rate plan, your electricity provider or utility, your service agreement ID and IDs relating to your utility service, your permission to operate date, your Device’s installed location, energy usage patterns, your Device’s power rating and energy capacity, Device identifiers (such as the serial number), the manufacturer and model number of your non Lunar DER, other energy telemetry and battery configuration information from such a third party owner, service provider of the Energy Management Program, installer, electricity utility provider, Non Lunar DER manufacturer, or other third party. You authorize the collection of and sharing of such information with us.
Other Third Parties. We may obtain your utility billing data (with your prior consent) from your utility provider. In addition, we may receive personal information about you from other third parties such as data or marketing partners. We may combine such utility billing data and other data collected from other third parties, with other personal information we have.
HOW WE USE THE INFORMATION WE COLLECT
We use the personal information we collect:
- Provide Services: To provide, maintain, improve, and enhance our Services;
- Use AI: To instruct, inform, train, develop, and improve the artificial intelligence, machine learning, and models that we use to support our Services;
- Improve our Services: To undertake activities to analyze, verify or maintain the quality or safety of our Services, and to improve, upgrade, and enhance our Services;
- Initial Purchase/Leasing Opportunities, and Subsequent Installation of a Lunar Home Battery System: To help you to investigate opportunities to purchase or lease, install, have delivered, and validated proper installation of a Lunar Home Battery System;
- Repair of our Services: To debug, identify and repair errors in our software that impair existing intended functionality, to restore functionality in our software, and to debug, identify, and repair, upload and process firmware updates on your Lunar Home Battery System;
- Monitor and Arrange Repair of Lunar Home Battery System: To monitor your Lunar Home Battery System’s performance, and identify, troubleshoot and work with installers or other third parties to repair faults in Lunar Home Battery Systems in accordance with our warranty obligations;
- Send instructions to Devices: To send instructions to operate or optimize your Device relating to our Services, such as solar energy optimization, time-of-use tariff optimization, and Energy Management Program operations;
- Marketing: For marketing and advertising purposes, such as developing and providing promotional and advertising materials and promotions, that may be relevant, valuable, or otherwise of interest to you, and to monitor the effectiveness of any marketing campaigns;
- Communication with you: To communicate, and provide you with details of the Lunar Energy App, and your Lunar Home Battery System performance, updates and other information relating to our Services, information that you request, responses to comments and questions, updates to Terms of Service, End User Agreements, and policies, safety information, questionnaires, feedback requests, and otherwise provide support, whether by text, push notification, or other communication method;
- Contract, communicate and connect with our Vendors and Service Providers: To provide installation and maintenance of Lunar Home Battery Systems, ascertain eligibility, set-up, maintenance or service of accounts, provide customer service, process or fulfill orders and transactions, verify customer information, enroll you on an Energy Management Program, verify your eligibility for such program, provide advertising or marketing services, provide analytics services, or provide similar services;
- Contract, communicate and connect with entities to whom we provide Services: To manage and develop relationships with leads, and to contract, communicate, provide reports, fulfil our contractual obligations and connect with business partners, such as third party owners of Devices, installers of Devices, Non Lunar DER manufacturers, providers of APIs, utilities, system operators, energy regulatory authorities, or other energy market entities, directly or via our portals; for example, we may monitor your Device’s performance, and notify your installer, the Device’s owner, or other third party, so that they can contact you to arrange maintenance of such Device;
- Validation of delivery of Services: To validate delivery of Services, such Energy Management Programs to third party owners of Devices, installers of Devices, Non Lunar DER manufacturers, providers of APIs, utilities, system operators, energy regulatory authorities, or other energy market entities;
- Enable Commercial Transactions: Otherwise enabling or effecting, directly or indirectly, a commercial transaction;
- Personalization: To understand your wishes, and personalize your experience on our Services and with our business, such as presenting tailored content;
- Training: To enable staff, installation and maintenance partner, and entities training as required for our Services;
- Safety Issues: To communicate and respond to trust and safety issues that may arise, including communication with first responders;
- Fraud and Incident Prevention: To detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity;
- Deidentify or Aggregate: To deidentify and/or aggregate information collected through our Services and use it for lawful purposes, for example to research behavioral differences, or for training purposes;
- Audit Interactions: For data analytics, and auditing purposes related to your interaction with our Services and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with other standards;
- Research: To undertake internal research for new products, technological development and demonstration;
- Compliance: For compliance purposes, including recordkeeping requirements for Energy Management Programs, enforcing our Terms of Service, End User Agreement and other legal and/or contractual rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
- Notified Purpose: For other purposes for which we provide specific notice at the time the personal information is collected.
HOW WE DISCLOSE THE INFORMATION WE COLLECT
We do not sell personal information. We disclose personal information we collect as described below or otherwise disclosed to you at the time of the collection.
Affiliates. We may share any personal information we receive with our affiliates for any of the purposes described in this Privacy Policy.
Utilities and Other Energy Institutions. We may share your name, phone number, email address, postal address, system installation details, energy consumption and generation, utility and other details with an energy utility provider or aggregator, independent system operators, software or SaaS providers, or other VPP providers, regional transmission organizations, solar companies and similar entities providing energy-related services to your home to register you or the third party owner of your Device, for Energy Management Programs provided by or to those entities and validate delivery of those services.
Regulatory Authorities. If you participate in an Energy Management Program, we may be required to disclose information regarding your home and your Device to regulatory authorities involved in the administration of those programs, including your name, email address, postal address, phone number, your Device’s power rating and energy capacity, your utility provider or load serving entity, your permission to operate date, and your service agreement ID, for the purposes of those authorities validating delivery of the relevant program.
Installation and Maintenance Partners. With your consent, we may share your name, postal address, email address, Wifi Network name, and phone number, and information about your property to facilitate a transaction with installers, channel partners, and potential third party owners. These communications may include promotional content and may be sent using an automatic telephone dialing system, including via text message. These installation and/or leasing partners include Sunrun. We may also share this information, together with information about your Device, including energy generation and consumption information, with installers and/or maintenance partners for the purposes of monitoring, servicing your product, and customer support. If your Device is owned by a third party owner, we will share your information as needed to enable them to monitor and manage their equipment, contract with third party entities (as described in Utilities and Other Energy Institutions above), and meet their contractual obligations.
Vendors and Service Providers. We may share any personal information we receive with our vendors and service providers as required for, and in connection with the provision of our Services.
Marketing. We do not rent, sell, or share personal information about you with non affiliated companies for their direct marketing purposes as contemplated by California’s “Shine the Light” law (Civil Code § 1798.83) unless we have your permission.
Analytics Partners. We use analytics services such as Google Analytics, Google Search Console, Mixpanel, and Crazy Egg to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/ and opt-out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout. Advertising Partners. We work with third-party advertising partners to collect and process your information in order to show you ads that we think may interest you. Some of our advertising partners are members of the Digital Advertising Alliance (https://optout.aboutads.info) and serve ads through cookie-based technologies. Please visit their opt-out pages to learn about how you may opt out of receiving certain web-based personalized ads from member companies. These opt-outs will apply only to our third-party advertising partners that are members of these organizations. These opt-outs will not apply when our partners serve ads through non-cookie based technologies. You can access any settings offered by your mobile operating system to limit ad tracking, or you can install the AppChoices mobile app to learn more about how you may opt out of personalized ads in mobile apps.
Third-Party App Integrations. If you connect a third party application to our Services, we may share information such as your name, email, images, and whatever content you choose to share with that third party.
As Required by Law and Similar Disclosures. We may access, preserve, and disclose your personal information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) in connection with fraud and incident investigations; (c) respond to your requests; (d) protect your, our, or others’ rights, property, or safety; or (e) enforce terms of service with you and/or with third parties. For the avoidance of doubt, the disclosure of your personal information may occur if you post any objectionable content on or through our Website.
Merger, Sale, or Other Asset Transfers. We may disclose and transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our business or assets. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.
Consent. We may also disclose personal information from or about you or your Devices with your permission.
YOUR RIGHTS AND CHOICES

If you reside in the European Economic Area or the United Kingdom, please also see “EUROPEAN AND UNITED KINGDOM RESIDENT NOTICE”.
Requesting Data Related to Household Energy Behavior. Users of the Lunar Energy App may access information related to their household energy behavior by requesting that data via the Lunar Energy App.
Update Your Account. You can update your Lunar Energy App account and profile information or delete your account through your profile settings. If you delete your account, you will lose access to your account, your personalized household energy information, and smart optimization services offered through the Lunar Energy App. Please note that even if you delete your account, we will still receive certain information from your Lunar Home Battery System and send instructions to it for safety and warranty purposes, including firmware updates.
Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt out of receiving promotional messages from us, you will continue to receive non-promotional emails from us concerning the behavior and operation of your Lunar Home Battery System.
Energy Management Program. If you end your participation in an Energy Management Program in accordance with the program’s terms and conditions, please note that it may take some time to process your request and disable Lunar’s automatic collection of information from your Device in connection with the program. Ending your participation in the Energy Management Program will not have any effect on our processing of information through other aspects of our Services, such as the Lunar Energy App or your use of other energy-related services. Please also note that Lunar may be required by law or contractual obligations to retain certain information regarding your participation in the Energy Management Program for recordkeeping and reporting purposes even after you end your participation.
If you choose not to provide us with the information we require, some features of our Services may not work as intended.
THIRD PARTIES
Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third party services or any personal information you disclose to these third parties. We encourage you to read their privacy policies before providing any personal information to them.
SECURITY
We make reasonable efforts to protect your personal information by using physical and electronic safeguards designed to improve the security of the personal information we maintain. However, as no electronic transmission or storage of personal information can be entirely secure, we can make no guarantees as to the security or privacy of your personal information. CHILDREN’S PRIVACY
We do not knowingly collect, maintain, or use personal information from children under 18 years of age, and no part of our Services is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at dataprivacy@lunarenergy.com.
JOB APPLICANTS
If you apply for a job with Lunar Energy, Inc., Lunar Energy Limited, or one of our affiliates, we collect personal information you provide as part of your application, such as your name, contact details, resume or CV, education, qualifications, employment history, skills, experience, interview responses, references, and other information you choose to provide. We may collect this information directly from you, through email, interviews, our Website, third-party recruitment platforms, or third-party job boards, such as LinkedIn.
We may also receive information about you from publicly available sources or professional networking sites where relevant to your application.
We use applicant personal information to process your job application, comply with legal obligations, and keep appropriate recruitment records. We may disclose your personal information to our vendors and service providers, such as third-party recruitment platforms and applicant tracking systems, to help us manage recruitment and process applicant personal information on our behalf.
If you are located in the U.K. or EEA, our legal bases for processing applicant personal information may include legitimate interests, such as recruiting staff for our business, contractual necessity where processing is needed to take steps before entering into an employment contract, compliance with legal obligations, and consent where required by applicable law. Where we rely on legitimate interests, we do so only where those interests are not overridden by your rights and interests.
We retain applicant personal information for as long as necessary for the purposes described above, including to complete the recruitment process, consider you for future roles, comply with legal obligations, resolve disputes, and maintain business records.
Applicant personal information may be transferred to, stored in, or processed in the United States, the United Kingdom, the EEA, or other countries where Lunar, our affiliates, or our service providers operate. Where required, we use appropriate safeguards for international transfers, such as Standard Contractual Clauses or another lawful transfer mechanism.

CALIFORNIA RESIDENT PRIVACY NOTICE
This California Resident Privacy Notice supplements the information and disclosures contained in our Privacy Policy. It applies to individuals residing in California from whom we collect Personal Information as a business under the CCPA.
Personal Information Collection, Disclosure, and Sale
For the purposes of this notice, Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, or as otherwise defined by the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (California Civil Code §§ 1798.100 to 1798.199) and its implementing regulations, as amended or superseded from time to time (“CCPA”).
Personal Information does not include information that is:
- Publicly available or lawfully obtained, truthful information that is a matter of public concern.
- Deidentified or aggregated.
- Otherwise excluded from the scope of the CCPA.
The chart below provides the categories of Personal Information and Sensitive Personal Information (as defined by the CCPA) we have collected, disclosed to a service provider or a contractor for a business purpose, or sold or “shared” (for cross-context behavioral advertising purposes) in the preceding twelve months since this notice was last updated. The examples of Personal Information and Sensitive Personal Information provided for each category reflect each category’s statutory definition and may not reflect all of the specific types of Personal Information and Sensitive Personal Information associated with each category.
Use of Personal Information
We collect your Personal Information for the specific business and commercial purposes described above in the section titled “HOW WE USE THE INFORMATION WE COLLECT”.
Collection of Personal Information
We collect Personal Information from the categories of sources described above in the section titled “INFORMATION WE COLLECT”.
Disclosure of Personal Information
In the preceding twelve months since this notice was last updated, we disclosed Personal Information to our service providers and/or contractors for the purposes described above in the section titled “HOW WE USE THE INFORMATION WE COLLECT”.
Your California Privacy Rights
If you are a California resident, you may exercise the following rights.
Right to Know. You may submit a verifiable request for information regarding the: (1) categories of Personal Information collected, sold, shared, or disclosed by us; (2) purposes for which categories of Personal Information are collected, sold, or shared by us; (3) categories of sources from which we collect Personal Information; (4) categories of third parties to whom we disclosed, sold, or shared Personal Information; (5) categories of service providers or contractors to whom we disclosed Personal Information; and (6) specific pieces of Personal Information we have collected about you.
Right to Delete. Subject to certain exceptions, you may submit a verifiable request that we delete Personal Information about you that we have collected from you.
Right to Correct. You may submit a verifiable request that we correct inaccurate Personal Information that we maintain about you.
Verification. Requests to know, delete, or correct Personal Information are subject to our ability to reasonably verify your identity in light of the information requested and pursuant to relevant CCPA requirements, limitations, and regulations.
Right to Opt Out. We do not sell or share (for cross-context behavioral advertising purposes) your Personal Information.
Right to Limit Use and Disclosure of Sensitive Personal Information. In some circumstances, you may limit our use and disclosure of your Sensitive Personal Information. We do not use or disclose your Sensitive Personal Information for purposes other than the limited purposes permitted by CCPA.
